Litigent is a software service. It is NOT a law firm. It does NOT provide legal advice. It does NOT create a lawyer-client relationship. By using Litigent, you acknowledge and accept full and sole responsibility for all legal decisions, filings, strategies, and outcomes in your matter. No person at Litigent AI Inc. is a lawyer, and nothing produced by this service constitutes legal advice of any kind.

1. Acceptance of Terms

By accessing or using Litigent (the "Service") operated by Litigent AI Inc. ("Company," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms") in their entirety. If you do not agree to these Terms, you must immediately cease all use of the Service.

These Terms constitute the entire agreement between you and Litigent AI Inc. with respect to your use of the Service and supersede all prior agreements, representations, and understandings.

2. Nature of the Service — Not Legal Advice

Litigent is a software-as-a-service (SaaS) platform that uses artificial intelligence to assist self-represented litigants in organizing, preparing, and understanding legal materials related to family law proceedings in Canada. The Service provides:

  • AI-generated legal information, summaries, and document templates;
  • Organizational tools for case facts, timelines, and evidence;
  • Reference materials derived from publicly available legal sources including CanLII;
  • Draft document frameworks for informational and planning purposes only.

The Service does NOT constitute legal advice, legal representation, or any form of professional legal service.

Nothing produced by the Service — including but not limited to AI-generated text, case summaries, draft documents, legal research, or agent outputs — should be construed as, or relied upon as, legal advice. No information provided through the Service creates an attorney-client relationship or any other professional relationship between you and Litigent AI Inc. or any of its personnel.

You are strongly advised to consult a licensed Canadian family law lawyer before making any legal decision, filing any court document, or taking any action in your legal matter. Failure to obtain qualified legal advice may result in adverse legal outcomes for which Litigent AI Inc. bears no responsibility whatsoever.

3. User Responsibility and Assumption of Risk

By using the Service, you expressly acknowledge and agree that:

  • You assume full and sole legal responsibility for all decisions made in connection with your legal proceedings, including any decisions informed by content generated by the Service;
  • You assume all risk associated with the use of AI-generated content, including the risk that such content may be inaccurate, incomplete, outdated, inapplicable to your jurisdiction, or otherwise unsuitable for your specific circumstances;
  • You are solely responsible for verifying the accuracy, currency, and applicability of all information, citations, legal references, and document drafts produced by the Service before relying on or using them in any legal proceeding;
  • You understand that AI-generated content may contain errors, including but not limited to hallucinated case citations, incorrect statutory references, inapplicable legal principles, or procedurally incorrect guidance;
  • Litigent AI Inc. is not responsible for any adverse legal outcome, procedural error, court sanction, adverse cost award, unfavourable decision, or other consequence arising from your use of or reliance on the Service;
  • You will not file any document with any court, tribunal, or government authority that has not been independently reviewed by a qualified legal professional, unless you knowingly choose to do so entirely at your own risk.

4. Accuracy of AI-Generated Content

The Service uses large language model AI systems to generate content. These systems are probabilistic and may produce outputs that are:

  • Factually incorrect or legally inaccurate;
  • Based on outdated legislation, regulations, or case law;
  • Inapplicable to your province, court jurisdiction, or specific circumstances;
  • Inconsistent with procedural rules in your jurisdiction;
  • Entirely fabricated (a known phenomenon in AI systems commonly called "hallucination").

Litigent AI Inc. makes no warranty, representation, or guarantee as to the accuracy, completeness, timeliness, suitability, or fitness for purpose of any content generated by the Service. All AI-generated content is provided on a strictly "as is" and "as available" basis.

5. User Accounts and Eligibility

You must be at least 18 years of age and a resident of Canada to use the Service. By creating an account, you represent and warrant that all information you provide is accurate, current, and complete. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree not to share your account with any third party, including opposing parties, their legal counsel, or any other person with an adverse interest in your legal matter.

6. Payment and Subscription Terms

Access to paid features of the Service requires a subscription. Subscription fees are billed in advance on a monthly basis in Canadian dollars (CAD). All fees are non-refundable except as required by applicable law. Subscriptions purchased through the Apple App Store are billed by Apple at the price displayed in the App Store at the time of purchase, in the currency the App Store displays, and are governed by Apple’s payment terms. Litigent AI Inc. reserves the right to modify pricing with 30 days' written notice. Continued use of the Service following a price change constitutes acceptance of the new pricing.

7. Data, Documents, and Evidence

You may upload, store, and manage legal documents, evidence, notes, and other case-related materials through the Service. With respect to such materials, you acknowledge and agree that:

  • You retain full ownership of all materials you upload to the Service;
  • Litigent AI Inc. is not responsible for the legal admissibility, authenticity, completeness, or integrity of any document, evidence, or material you upload or generate through the Service;
  • No backup guarantee is provided. We maintain encrypted operational backups for disaster recovery, but these exist for infrastructure resilience and are not a user-facing restore service. We do not guarantee that any particular file can be recovered, and we do not accept individual restore requests. You should keep independent, local copies of all important documents and evidence at all times;
  • You are solely responsible for ensuring that documents you store or generate through the Service meet the evidentiary and procedural requirements of your jurisdiction;
  • Litigent AI Inc. shall have no liability for loss, corruption, unauthorized access, or unavailability of your data, regardless of the cause.

8. Prohibited Uses

You agree not to use the Service to:

  • Submit false, fraudulent, or misleading information to any court or tribunal;
  • Harass, threaten, or intimidate any opposing party or their legal counsel;
  • Engage in any activity that constitutes an abuse of process;
  • Violate any applicable law, regulation, or court order;
  • Reverse engineer, scrape, or extract the Service's underlying systems or AI models;
  • Resell or redistribute access to the Service without written authorization from Litigent AI Inc.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

LITIGENT AI INC., ITS DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR RELIANCE ON THE SERVICE, INCLUDING BUT NOT LIMITED TO:

  • ADVERSE COURT DECISIONS, ORDERS, OR JUDGMENTS;
  • ADVERSE CUSTODY, ACCESS, OR PARENTING ARRANGEMENTS;
  • FINANCIAL LOSSES, COST AWARDS, OR SUPPORT OBLIGATIONS;
  • LOSS OF LEGAL RIGHTS OR REMEDIES;
  • LOSS OF DATA, DOCUMENTS, OR EVIDENCE;
  • ERRORS OR INACCURACIES IN AI-GENERATED CONTENT;
  • ANY OTHER OUTCOME IN YOUR LEGAL PROCEEDINGS.

IN NO EVENT SHALL LITIGENT AI INC.'S TOTAL CUMULATIVE LIABILITY TO YOU EXCEED THE TOTAL SUBSCRIPTION FEES PAID BY YOU IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT. LITIGENT AI INC. DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.

11. Indemnification

You agree to indemnify, defend, and hold harmless Litigent AI Inc. and its directors, officers, employees, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your legal proceedings; (d) any content you upload or generate through the Service; or (e) your reliance on AI-generated content.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of New Brunswick and the federal laws of Canada applicable therein. Any dispute arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of New Brunswick, Canada.

13. Modifications

Litigent AI Inc. reserves the right to modify these Terms at any time. Modified Terms will be posted on the Service with a revised effective date. Your continued use of the Service following posting of modified Terms constitutes your acceptance of the changes.

15. Severability

If any provision of these Terms is held invalid, illegal, or unenforceable in any jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable or, if modification is not possible, severed. The remaining provisions continue in full force and effect. If a provision is unenforceable as to one user or in one jurisdiction, it remains enforceable as to all others. Nothing in these Terms excludes or limits any right you have under the consumer protection legislation of your province of residence, or any liability for gross negligence, wilful misconduct, or fraud.

16. Your Litigent File Is Not Privileged

Because Litigent is not a law firm and no lawyer-client relationship exists between you and Litigent AI Inc., the information you enter into the Service is not protected by solicitor-client privilege. It may be subject to disclosure, production, subpoena, or court order in your proceeding or in another matter. Consider carefully what you record here, and ask a licensed lawyer if you are unsure what is protected.

17. Automated Safety Detection

Litigent automatically scans the messages and voice transcripts you send for indications of immediate danger, self-harm, or child abduction. Where one is detected, the Service stops generating and shows emergency contact information instead of continuing. This is an automated system. It is not monitored by any person, it will not detect every situation, and no one at Litigent AI Inc. is notified or alerted when it triggers. Litigent is not an emergency service. If you are in danger, call 911 in Canada, or your local emergency number.

18. Referral Program

Litigent offers an optional referral program. Any registered account holder may share a personal referral link; a person who registers through that link is attributed to the referrer on a first-touch basis. Referrers earn a commission equal to 25% through December 31, 2026 of the amount actually received and settled in United States dollars by our payment processor (Stripe) for each subscription payment made by a referred user, for as long as that subscription remains active. The commission basis is the settled amount after any discounts and after any currency conversion applied by the payment processor; it is not calculated on list prices. Subscriptions purchased through the Apple App Store are processed and collected by Apple, which retains a commission of up to 30%, and those proceeds are not received through our payment processor; App Store purchases therefore do not generate referral commissions. Commissions remain pending for 30 days to cover the refund window and are reversed, at any stage, if the underlying payment is refunded, disputed, or charged back. Approved commissions of US$25 or more are paid monthly by transfer to the referrer’s connected Stripe account; completing Stripe’s onboarding, including identity and banking details, is required to receive payouts, and balances below the minimum roll forward. Referrers are responsible for their own taxes on commissions and for conducting their promotion lawfully, including compliance with anti-spam legislation; self-referral, misrepresentation of Litigent, or abusive promotion forfeits unpaid commissions and may result in removal from the program. Litigent AI Inc. may modify or discontinue the program prospectively at any time; commissions already approved at the time of a change remain payable.
